How protection works
A registered trademark gives its owner exclusive rights to stop third-party use, except for legitimate use following a trade relationship the owner started, as long as the goods were not altered.
Trade names are protected under Law 20-00. Rights arise from first use in commerce rather than registration, and are lost if the name goes unused for five years.
Trademark registration lasts ten years and is renewable for consecutive ten-year periods. Renewals require proof of use, or a declaration of use or non-use.
Documents needed to file
- Applicant details: country or state of incorporation (for companies), representative's name, passport number and address
- The exact form of the mark, including lettering and any claimed colors
- For designs or labels, six color samples
- Description of the goods and services to be protected
- For Paris Convention priority: a certified copy of the home-country filing (no further legalization)
- Power of attorney signed by the applicant, notarized and legalized at the nearest Dominican consulate
